Confidential Information does not include information that is or becomes publicly available through no breach of this agreement by the receiving party, was already in the receiving party's possession without confidentiality obligation at the time of disclosure, was independently developed by the receiving party without use of or reference to the disclosing party's Confidential Information, or was rightfully obtained by the receiving party from a third party without confidentiality obligation.

Confidentiality obligations under this section shall survive the termination or expiration of any service agreement for a period of five years, or indefinitely with respect to trade secrets and other information protected under applicable law.
